(00:00) Normally people they have lost lot of assets or money. Where will the water go? The only passage which we have in the entire city is through Musi. They not filing the Fleb.
(01:06) Now responsibility [music] is on those parents. Go back, manage your house. You are the minister of the house. foreign [music] unmarried couple relationship it's a consensial they have sex right male is not accepting for the marriage so female aim right living relationship are considered as marriage. So
(02:00) printing because that's confidential citizen We all know and it's very important. It's a mustwatch very valuable content. Uh sir welcome to 1 billion dreams with
(02:50) >> thank you >> sir uh migur few words who are you know [laughter] >> basically I'm a senior advocate >> so we have 150 juniors across the country >> we have seven offices and uh we handle all cases >> so we call ourselves as a 360deree law firm >> so we have a phrase we say you name it we fight it that's we have as a goal in [snorts] our practice area.
(03:20) >> Got it. Got it. Got it. [clears throat] You have handled lot of cases. So sections of people they have lost lot of assets or money. government. >> See, originally if you see why Hydra has started, >> yeah, >> Hydra has started to bring back those lands >> which originally belonged to state government. >> Okay.
(03:58) >> But were encroached for some reason. >> Okay. >> Where occupied on Kundi, encroached on maplo. That's it. >> Whenever you say there is a land, there is something called survey number. Now survey number goes back to something called the village map. Village map will be into district. District will be into state.
(04:18) >> Got it. >> Just because you have divided a village or you have corrupted a village. It doesn't become it doesn't change the nature of the land. >> Good. >> Take a nature of the land low we define two things. FTL properties FTL lands. FTL lands are where there is a possibility of water being flowed.
(04:40) It's an irrigation prone area. Mhm. >> So once you classify as FTL land, >> you cannot make a construction in it. >> Having said that hydrao we majorly we focus on as a river >> let's say about 10 cets of rain is there. >> Okay. >> Where will the water go? >> Okay. >> The only passage which we have in the entire city is through Musi. Okay.
(05:20) >> Because water does not know what to lift, what not to lift. Yeah. Yeah. Yeah, >> correct. >> Correct. >> Now when Hydra started first focus was whatever were these lands. Yes. Originally if you see Yeah.
(06:12) Okay. Inherent risk they never invented. They never discovered. Correct. Yes. >> Now there is a process when you start a government entity. There is a construction genuinely you know that it is wrong and you have occupied that place. >> So technically compensation need not be given but government sometimes gives compensation.
(06:56) E >> first notice >> see that's a river area >> it is not inhabited you cannot inhabit that place not department. Yeah. The process of river flow or water flow is reinstated. This is the original logic. Next
(07:52) coach. Perfect. Yes, >> that's a mistake. >> Correct. Got it. >> So you give notice today, you demolish tomorrow. It's wrong. >> Yes. >> Because 21 days is mandate. >> Yeah. 10:30 notice given 1035 demolition starts. >> This is also wrong. Yeah. Yeah. So for such activities stays were granted. Genuinely when the process was followed courts were silent process Hydra has taken steps >> contempt.
(08:36) >> Yeah. >> In fact there was high court orders where the honorable judges said he is not following an order suspend him. You cannot say no to a court and there's a court order. There is a study. >> Court has not just passed order just like that. Yes. [snorts] Judges have been furious on standing councils for hydra.
(09:10) What is this? What are you doing? >> They have not followed the process. That's the reason judge is furious or else there is no personal limit to anyone. That is the whole story. There are benefits. [clears throat] Okay. >> So when there is a notice
(09:57) >> Yeah. >> There is something called bonafide purchaser you are not aware. >> Okay. >> Okay. [snorts] register. Yes. Construction. Yes sir. Bank, right? Yes.
(10:44) Yeah. We got a concerned courtified purchaser. Now I am the bonafide purchaser which a regularized building scheme. >> Got it. >> That being correct. You can't remove me. >> That's why it stays. >> Now since this is correct compensation goes by reverse logic. Suppose there's a person. Okay. accidental
(11:46) high [clears throat] floor problems, lungs problems. And there are several people are fighting against it. So >> density of air, >> whatever particles are low weight. >> Correct. brick manufacturing. Yes.
(12:35) >> That ash itself is in the air. >> Yes. >> It is thin dust. Perfect. >> Same problem. Yeah. I've heard people saying it doesn't go till 40 floors. >> It stands at 25 floors. >> There are school of thoughts which say it's at 15th floor. >> Some say it goes till 30. >> But all sudden logically after 15 floors somewhere pollution settles.
(13:13) M >> you see any highrise. >> Yeah. What window 50th floor window paralle Yeah. Yeah. Correct. >> And that's every time.
(13:56) >> Yeah. Yeah. >> Sometimes you see in summer also >> technically [clears throat] it's at risk. >> So I've seen people not opening windows. >> Correct. So what's ideal flow sar? >> To the best of my understanding 10 is good. >> 10. Got it. And >> 15 is stretched >> beyond 15. I personally don't prefer >> good. >> But if someone comes to a legal opinion, not scientific opinion.
(14:28) >> I'm not a doctor. >> So it cannot be watched. >> Got it. >> If someone comes for a legal opinion, sir, I'm taking 50th floor so and so flat number. We see only project report. What is the TDR filed? What are the approvals given? And what are the fire safety issues? M >> that's always a question mark on fire safety and we say okay opinion wise it's good go ahead >> but where I am not personally satisfied one is what benefit you are giving for that heavy air flow what is the additional protection >> to the best of my understanding
(15:12) >> I have not seen any different protection Second atmosphere. I've seen people at fourth floor putting grills. At 40th floor, if you don't put grills, you're putting people at risk. >> Mhm. >> Third aspect, gas cylinders. Generally, you find people putting gas into the balcony
(15:57) if fire breaks out. What is your preparedness? Fire sprinkler. Yeah. Yeah. 40th floor. Wind is also high. 40th floor,
(16:57) 50th floor. Yes. So where is the safety measure? Interesting thing is [clears throat] this is not discussed in your building approval. >> Yes. >> Because what is building approval? Structure, strength of construction. >> Can these beams bear that structure? >> Is the land belonging to you? >> Yeah. But this is the risk.
(17:45) >> So that is one challenge which I think everyone is silent. regarding fire safety there is there are two things one is called proximity of fire >> okay >> today we have nine towers at one place >> three towers at one place >> standalone tower problem >> suppose fire breaks out in tower A >> I can actually stand put my equipment of fire safety water just extinguishers >> in tower B which is opposite to tower A
(18:33) >> try to extinguish fire here. >> Perfect. >> Easy possible. >> Yeah. Yeah. >> Stand. Yeah. >> Standing towers. >> This is my understanding of fire safety. But always it is better to have an expert consultant. >> Yeah, >> really that is feasible or not. [snorts] 40th floor. This was my generic question. Yes,
(19:19) >> because that is your deciding factor. >> Correct. >> Fire extinguish. It's not the quantum of water which you pour. It is the force at which the water comes >> that's also important. >> Correct. I have I did not get answer till now. >> So I cannot say on that. >> Got it. [clears throat] So suggested is 25 floors. Yeah.
(19:48) Yeah. >> 15 seconds you can actually go for rescue measures. Yeah. Latest we have seen extinguishers where fire breaks a bulb because of the heat. >> Yeah. >> Extinger explodes. [clears throat] Fire is combusted. >> Yeah. Because generally whenever I have to go to any of colleges or schools, whenever we try to do an audit or an inspection, first thing which I see is date on which the fire extinguisher [snorts]
(20:32) pin is written. M >> 6 months >> last year [laughter] >> that issues are we have to be very clear as per the >> someone by mistake throw a cigarette butt extingu it catches fire faster.
(21:21) Insurance [clears throat] building. There was a case where there was a factory >> fire broke out. >> National insurance. >> We were filing on behalf of national insurance. >> So we saw the survey report. >> Survey report said
(22:06) electricity was not being supplied from past 6 months. supply factory. So it is a man-made activity. It is not an accident. >> So surveyors are not fools. >> They know what to check, how to check. Fire breaka. It's not an immediate claim which you
(23:03) are doing. >> Correct. >> Claim is liable to be rejected. So parameters. >> Yeah. But there are measures, there are spectrums in which we decide [clears throat] issues [sighs and gasps] and they they're not filing two times they're not doing I don't know might be any reason
(23:50) >> you have given a complaint >> police si admin has taken the complaint >> first rule >> petition acknowledgement state This is called petition acknowledgement >> tg/h26 for example Mhm. Police will look this case in a
(24:51) different way. 10K. It's a commercial transaction. recovery suit. So these are certain cases which police are not expected to enterain. I know that there is a fraud. Yeah. Then also they are not motivated. Your next step is you go to Indian post complaint
(25:37) speed. >> Now police officer there is no reaction. >> Who is the next authority to the police station? ACP. [clears throat] >> No reaction. complaint. He has not responded. >> Nothing is filed. >> You intimate this to ACP after 3 days. >> Got it. >> of such a receiving complaint. >> Got it. >> No response. Yeah. >> DCP no response.
(26:14) >> Go to the concerned court. >> Take the help of any advocate. >> File a 223 petition. >> Okay. Examination of complaint by magistrate. >> Got it. >> So magistrate will see this complaint, direct the police to file a fire. >> Got it. >> There's a procedure under BNS. That procedure is followed. >> It is doable >> but you have to follow this procedure.
(26:42) >> Got [cough and clears throat] [sighs and gasps] sir. Normally first of all question authority is called interception. >> Okay. >> Interception information.
(27:46) Good. Right. Got it. >> This is happened. Accept. If you agree, we'll search right now. M you want to exercise your rights. Okay. >> No problem. Next process starts. Got it.
(28:44) Right. Spending the boundary. Mhm. And second also [cough and clears throat] police officer sees the way you drive
(29:29) when they are in your front. Ratri 839 check four00 600 match kilome >> [laughter] >> So experience. Yeah. >> They identify. Yeah.
(30:14) >> See it is their experience. They have seen so many people. >> Yes. Purpose is not to catch people. >> Purpose is to eradicate the second case. drunk and drive. You are a risk on the road. >> They can seize the vehicle there. >> Seizing authority. >> So in NDPS case there is a possibility of seizing.
(30:53) In a drunk and drive case there is a possibility of se seizing >> only when driver is drunk. Got driver. So that is what you have to work out. So that is the reason why those developments have come. [clears throat] police but
(31:44) he is not one person group activity. But generally it has happened. It is not that it never happens. >> It has happened. But will it happen always is a question mark. Take a random case where drunken drive checks
(32:46) occupancy. at the end of the day police is also not a superhuman being they are human beings. >> Yes. Yeah. In first case, in second case now that is a challenge all those factors count. Mhm. So based on real stories
(33:34) there was a time where the entire police station was attacked. >> How it was attacked? Later in the investigation they found out that it means about seven or eight roads they have blocked >> ensured that this police station will not need help. Yeah. So that is proximity [clears throat] and possibility. There are times where it happened. Got
(34:21) it? >> But now it is all cyber zone. >> People are more interested to do cyber crime than physical crime. >> So zone has changed. Got sir. wife, husband. boundaries. >> Why marriage is done?
(35:19) Two people want to live together in an understanding way. >> Right? Now what is understanding? understanding >> today. [clears throat and cough] I heard one of a senior police officer saying this. If a husband starts, if a person starts
(36:08) earning, boy, >> there's a high chance he'll think of family. >> High chance. >> If a female starts earning, >> that's >> there is a high chance of ideas of independency and independent ideology. But all said and done, female's memory power >> is thrice the memory power of a man. >> Channeling difference, >> female memory power, family benefit, family bondage.
(36:51) That's the most lovable family of all. grow togetherness. Independence is misinterpreted. M [laughter]
(37:37) what is it >> [clears throat] >> world porn p shape correct. Yeah. >> So starting when anyone tries da it is only there is no shape >> but slowly it takes shape. Perseverance, focus in that activity, affection in which you do combination as a chef.
(38:28) That is the logic. Correct. Correct. There is a compensation. But in family if you start thinking of compensation I've seen many people saying I sacrificed because of any divorce cases which you fight common statement which female say is I sacrificed for my husband >> hence my husband is successful >> it's wrong correct statement is I supported my husband >> who supported me in the family.
(39:06) Hence our family is successful. This is correct statement. >> This is somewhere missing. If there is a sore marriage now responsibility is on those parents. It's your life now. It's a nuclear family. Satellite is detached from the source. >> So satellite has to run by itself.
(39:52) Go back. >> Manage your house. >> You are the minister of the house. [cough] Yeah, somewhere it is parents blender. is one second most important thing.
(40:40) First teacher for anyone is mother confusion. If the mother says keeping both of them boy and the girl A presentation difference. This is one. Second same mother.
(41:37) Whenever you have a problem siting Now choice is yours. This parents of both the parties have to
(42:21) teach. >> What I see is today's marriage are not made in heaven. They are made in hotels >> and before hotels there are meetings. >> In these meetings there are interviews. Best marriage combination Netherlands.
(43:35) So this is what is required in marriages. So dsha concept basically irritation was many I have seen a case where the girl said in her diverse petition correct we in our cross examination constantly ask the question room. Her answer was no. He was in a different room. She was in bedroom. He was observing her legs.
(44:15) Is her statement. Now the biggest question is how did she know? And this was in affair. This was in her statement. >> This was in her cross. This was in her final prayer also. Diverse was granted. M practically impossible [clears throat] room. So many things come into play. >> On the face of it, what they are saying is wrong.
(44:54) You can understand why they are saying they don't like that marriage. M >> now here the question most important question is not to answer why they don't like marriage I pain they don't like you have two choices live by suffering terminate start fresh because today marriage Hindu marriage is a contract today we are writing something called three nuptial agreements for wedding photo shoot.
(45:31) [clears throat] We have heard cases where today post marriage honeymoon parents are going [laughter] >> [snorts]
(46:19) >> So there's a huge change now. So this is something which people have to understand. You don't like a person you didn't want to accept to hell with your family reputation and respect. If that fellow dies, >> it's a case anyhow repetition will go. >> And there's a rule of law. >> If a girl dies within one year of her marriage, >> it's a dy death.
(46:46) >> A1 is husband. Same reverse. >> If a boy dies within one year of marriage, it is harassment. >> Wife is on concept. Hot recently software months once exited. There is a rule of some high court has recently given I think Kerala high court has
(47:32) recently given a judgment which says if the girl is earning >> there's no question of alman >> almony is a case of maintenance where the person does not have facility or availability and uneducated person is totally uneducated but rahu right madam okay okay okay okay painting extraordinary each painting of that girl
(48:17) sells at about 35 to 40,000 on an average she can sell two paintings a month no maintenance no alimmony Because there is earning capacity. There is no earning capacity at all. Then maintenance. >> This is protection for females act. But now law, society both have evolved >> and courts are very clear.
(48:54) Now there is a case which Supreme Court has given in that Supreme Court gave guidelines. Honorable Supreme Court guidelines was very simple. When you are filing a divorce petition, you are supposed to give declaration of assets and liabilities. income husband as well as wife. When it is assessed that wife is capable of earning there is no alman >> there is no intermaintance you cannot that clarity is there living relationship are considered as
(49:43) marriage exactly >> see the point is living relationships are marriage living relationship beyond two Yes. Equals to doomed marriage. >> Okay. >> Society believes they got married. Got it. Yeah. >> Okay. Similarly, we are not talking about 70 years of man. 13 years of quail. >> We are talking about an age bracket
(50:29) which is 5 to 10 years of difference. >> Good. >> So they're living together for more than 2 years. >> It's deemed marriage. Why? Because when there is no marriage if there is a child born >> this child becomes illegitimate child [snorts] living supreme court honorable Supreme Court has also given one more guideline which many did not accept. cept but it
(51:15) was if there is an illegitimate child that means the lady has an extrammarital affair >> and the child is born out of extramarital affair father continues to be same fellow >> married person combination Okay. Child has not done any mistake. Correct. So we can't destroy child's future. So when a court decides, it sees many things in the society and decides.
(51:56) >> Correct. Correct. Correct. Uh unmarried couple and it's a consensial they have did sex right male is not accepting for the marriage so female aim right so see though it is consensual Now consensual at that point of time for any case >> where it is a if the female goes for a complaint she books it as a rape case >> under BNS
(52:43) >> false promise sex thereon >> is a crime >> it's qualified as rape >> now the question is whether the original two years back when That fellow made a promise was a genuine one or not. There's no proof. >> Today it's not a marriage. Right. We have seen where members of the forces >> both were in the same force. >> Both had consensual sex.
(53:25) M >> later the boy declared that I'm not going to marry. >> M >> girl went and complained to the seniors that this has happened. [clears throat] >> The senior suggested to book a case >> and we are sure he'll be convicted. The reason is first time when sex happened there was consent >> agreed >> but that consent was because of promised marriage >> marriage.
(54:05) >> Hence from there till the last >> the entire sequence becomes crime. >> So the female can as such go and file a complaint. But fundamentally you see why >> entire system of marriage technically It is a crime.
(55:02) >> [laughter] >> Basically society has changed >> in a way where people are not bringing their gender while discussing situation Bro, >> but emotions are still the same. >> Correct.
(55:49) So when emotion continues, business activity, cultural activity, >> office bro that's a fantastic culture. >> You are able to gel and get work done. Super limits employment living relationship. >> So as long as it is in the limits >> it's fine >> or crosses limits then it becomes an issue.
(56:32) >> If there is a living relation both are consenting >> have an agreement >> and a living relationship agreement. M living relationship sly. something called intention. >> Article 194 of constitution of India >> talks about something called breach of privilege
(57:18) >> of an assembly or a parliament >> or in fact any place where public is involved. Wearing a color dress is not wrong. >> I've seen many people who wear full black, jet black. I like blackard and I like black
(58:07) friendship. I was surprised to see that fellow has 300 different pairs black color only. So color is not wrong. [clears throat] thousand days Congress party. party,
(59:11) right? Peaceful protest. point. Correct. Yes. Defense
(1:00:01) unlawful assembly. So an unlawful assembly can hamper public order. study. [clears throat] Yeah. Yeah. Extreme scenario. Mhm. [clears throat]
(1:00:58) Pres. people representatives. >> It's wrong. >> If they have violated on the face of it, article 194, these people have also violated powers of police. >> As a police officer, you don't have authority to manhandle a person, >> let alone an MLA or a people for Example,
(1:01:46) police offic penalty. So important. Mhm. More [clears throat] police
(1:02:47) tone sentence both have impact. So bank of almost 31,000 multiple bank of case is different. It is 35,617 crores >> according to RBI. Whatever statements Bank of Buna is filed something happened they have defaulted.
(1:03:37) So the total of all those accounts is 35,617 crores. They have written off that amount. media. Bank of denied disclosing their names and details. But to the best of my understanding, RBI knows who they are. Uh so government
(1:04:28) cheat funds basically registered unregistered cheat funds. If registered cheat funds they get registered with someone called register of cheats register of margin. So registered cheat fund you have a complete system which register of cheat funds for example you know
(1:05:15) >> I should give a reserve of 10 lakhs with register of chits 20% amount must be with the register >> okay >> that is the authorized capital which you hold there >> got it >> so if my number of chits go up my reserve also goes up >> got it Perfect registration advantage. Got it. Maintains all this proceedings.
(1:06:01) Mhm. register of chit is the arbitrator for >> ch disputes. >> So a preddecided >> not till 5 months or 10 months. option because there is some amounts already there. Yeah,
(1:06:44) >> correct. Correct. Let us say 100 people 20 months same combination same dividend concept same part about them same action fundriv [clears throat and cough] Same logic,
(1:07:38) private finance. Correct. Daily right now. Daily finance, private finance, source of correct jump. private finan fun. Correct.
(1:08:45) Daily finance. Daily finance. reverse 90 days. Okay. Says concept Bungalow Bungalow startover. foreign
(1:09:56) countister right >> because that's confidential. >> Yeah. Yeah. Yeah. Now after 3 years of extensive work, office staff, cash counting machines, computers, superl. I am investing. I am taking five lakh Banglad 25.
(1:10:51) Yeah. office jump. Next option public nearest police station. Yeah. Yeah.
(1:11:39) >> So it is very difficult to recover now. Mistake unrest. stock market [laughter] same logic. So that is the mistake that's happening. greed factor
(1:12:45) [clears throat] might be a friend WhatsApp me WhatsApp WhatsApp text is valid evidence in one case there was nothing except WhatsApp evidence WhatsApp statement WhatsApp conversation statement recovery
(1:13:34) >> bank statement WhatsApp >> statement 65B of IT act 65B of evidence act certificate AC file >> these evidences were considered >> person did not contest expert order was granted with reasonable interest of 6% attachment So
(1:14:27) a court order exeute but technically for your question WhatsApp conversation is valid as secondary evidence primary evidence proof Proof of payment cross examiner. Judge also will accept proof of payment required.
(1:15:21) eyewitness is circumstantial evidence. >> Okay. >> Eyewitness will help. Okay. >> But eyewitness independent. Okay. Blood relations witness is not independent. M >> independency of witness >> testification is valid >> else it becomes difficult. >> Got it sir. Uh last session sir rapid fire round.
(1:15:54) So we call it as billion fire round. Okay. One word answer just 10 questions. Hydra necessary or dangerous? >> Necessary. Government versus common man. Who has more power? >> Government. >> Police. Fear or friend? >> Technically fear for common man? >> False case. What should be the first move? >> Get documentary evidence done first. >> Collect evidence before fighting.
(1:16:35) Guilty client or charge defend or refuse? >> For a lawyer, >> yeah, >> it is defense. >> Defending the client. >> Guilty or not is >> problem of the judge. >> For a lawyer, it's defense. >> WhatsApp. Evidence or danger? >> Evidence. >> Property buyer. Biggest mistake. >> Not seeing documents and not holding documents. M. holding documents.
(1:17:06) >> You assume things are correct. >> That's the biggest mistake. >> A lawyer, justice or money? >> Justice. >> One law every Indian must know. >> Constitution of India. >> Sorry. >> Constitution of India. >> Okay. >> That's the mother of all laws. You should know it. >> You like it or not, you should know. That's our biggest problem.
(1:17:40) Thank you so much. Thank you so much for your time. Thank you so much. >> Thank you.
